An off-duty Immigration and Customs Enforcement agent was shot and arrested in Fresno, California, after allegedly attacking a 72-year-old man and his daughter outside their home.

The shooting happened early Friday, October 9, 2026, in Fresno’s Tower District.

Police identified the wounded agent as David Gonzalez, 32, of Texas.

According to investigators, Gonzalez was sleeping on a stranger’s front lawn before a confrontation that ended with the homeowner firing one shot.

However, the investigation took an unusual turn. Rather than arresting the homeowner, Fresno police took the injured ICE agent into custody on felony assault allegations.

Woman Finds ICE Agent Sleeping on Her Fresno Lawn

The incident happened near East Dudley Avenue and North Broadway Street.

At approximately 3:19 a.m., Fresno police received reports of a gunshot in the neighborhood.

Investigators later determined that a woman had returned home and discovered an unfamiliar man sleeping on the lawn.

The woman alerted her 72-year-old father, who lived at the residence with her.

Her father then went outside and attempted to get the man to leave.

Police subsequently identified the man as Gonzalez, an off-duty federal immigration agent.

Police Say Gonzalez Attacked the Father and Daughter

According to the Fresno Police Department, Gonzalez appeared intoxicated and agitated when the homeowner woke him.

Investigators say Gonzalez then physically attacked the 72-year-old man, causing visible injuries and knocking him to the ground.

When the man’s daughter attempted to intervene, police allege Gonzalez attacked her as well.

The confrontation quickly escalated.

Police reported that the father feared for his safety and that of his daughter.

At that point, the 72-year-old pulled out a firearm and fired a single shot.

The bullet struck Gonzalez in the midsection.

Police have described Gonzalez’s behavior as appearing intoxicated. However, no publicly verified toxicology results were identified in the reports reviewed for this article.

Off-Duty Police Officer Handcuffs Injured ICE Agent

After the shooting, the woman contacted her boyfriend, who works as a police officer.

Although he was off duty, the officer went to the residence and placed Gonzalez in handcuffs.

When responding Fresno police officers arrived, they found Gonzalez wounded and restrained.

Emergency medical personnel transported him to a nearby hospital.

ABC30 reported that Gonzalez was in serious condition following the shooting.

Police also confirmed that Gonzalez was a federal agent from Texas assigned to U.S. Immigration and Customs Enforcement.

However, investigators said he was off duty and alone when the incident occurred.

They have not publicly established why he was at the residence or in the neighborhood.

Why Was the 72-Year-Old Man Not Arrested?

Fresno police say the homeowner legally possessed the firearm used in the shooting.

Investigators also determined that he fired because he feared for the safety of himself and his daughter.

Based on the information established during the initial investigation, officers announced that the 72-year-old would not face criminal charges.

Police have not publicly identified the father or his daughter.

Meanwhile, Gonzalez was taken into Fresno police custody on felony assault allegations.

Fresno police continued gathering evidence after the early-morning shooting.

ABC30 reported that its news crew witnessed detectives recover a handgun from the home’s porch. Investigators placed the weapon in an evidence bag for processing.

A neighbor, Kimberly Lindsay, also spoke with the station.

She described the residents as longtime neighbors and said the family had lived there for more than two decades.

The incident has drawn attention throughout Fresno as questions continue about why Gonzalez was in the neighborhood.

Fresno Police Address Conflicting Reports About ICE

Another development emerged after local officials raised questions about an alleged interaction between Fresno police and ICE personnel at the hospital.

GV Wire reported that ICE personnel sought to take custody of Gonzalez. Fresno City Councilmember Miguel Arias publicly supported that account.

However, Fresno Police Chief Mindy Casto disputed the report.

Casto said no such request had been made and confirmed that Gonzalez would remain in Fresno police custody.

The department subsequently issued another statement denying that a confrontation occurred between the agencies.

Police said ICE officials had contacted the department regarding their own personnel investigation.

The accounts remain disputed, and no confrontation between the agencies has been independently established in the reporting reviewed.
